This Privacy Policy describes how Click Digital, operating the Kliq platform ("Kliq," "we," "us," or "our"), collects, uses, stores, shares, and protects your personal information when you access or use our web and mobile platform (the "Platform").

Your privacy is important to us. By accessing or using the Platform, you consent to the collection, use, and disclosure of your information as described in this Privacy Policy. If you do not agree with our policies and practices, please do not use the Platform. This Privacy Policy is incorporated into and is subject to the Kliq Terms & Conditions of Service.

1.1. Information You Provide to Us Directly

  • Account Information: When you create an Account, we collect personal information such as your name, email address, password, and other information you choose to provide.
  • Profile Information:
    • For Brands: Company name, contact information, commercial registration, billing address, payment information, marketing objectives, industry, and other information relevant to campaign creation.
    • For Content Creators: Social media handles and links, bio, profile picture, demographic information (e.g., age, gender, location, interests), content niches, past campaign experience, expected rates, audience demographics, and performance metrics. You authorize us to obtain certain public and authorized personal information from your linked social media accounts as per your platform settings and our Privacy Policy.
  • Campaign Data: Information related to campaigns you create or participate in, including campaign briefs, proposals, agreements, deliverables, communications between Brands and Content Creators, and feedback.
  • Payment Information: When you make or receive payments through the Platform, we collect payment details such as bank account details for payment purposes. This information is processed by our third-party payment processors, and we do not directly store sensitive payment card data.
  • Communications: Records of your communications with us, including customer support inquiries, feedback, and survey responses. This also includes information you provide when you communicate with other users through the Platform.
  • Surveys and Feedback: We may collect information from you through surveys or feedback forms.

1.2. Information We Collect Automatically

  • Usage Data: Information on how you access and use the Platform, such as the pages you visit, the features you use, the links you click, the searches you conduct, and the time and date of your activities.
  • Device Information: Details about your device, including your IP address, device type, operating system, browser type, and mobile network information.
  • Location Information: With your consent, we may collect information about your location when you use the Platform.
  • Log Data: Server logs may include your IP address, browser type, referring/exit pages, and timestamps.

1.3. Information We Collect from Third Parties

  • Social Media: If you connect your social media accounts to the Platform or use social media logins, we may collect information from those accounts, such as your profile information, public posts, follower counts, and engagement metrics.
  • Third-Party Services: We may collect information about you from third-party services that you use in connection with the Platform, such as payment processors, analytics providers, and fraud detection services.
  • Publicly Available Data: We may collect information about you from publicly available sources, such as social media platforms and influencer databases, to enhance your profile and provide relevant recommendations.

2. Our Role as Data Controller and Processor

Kliq acts as a Data Controller for the personal information we collect directly from you for the purpose of providing and managing your access to the Platform, processing subscriptions, and for our own marketing and operational purposes.

When Brands use the Kliq Platform to collect or manage personal information about Content Creators (or other individuals), Kliq acts as a Data Processor on behalf of the Brand. In such cases, the Brand is the Data Controller, and Kliq processes such data strictly according to the Brand's instructions and our agreements with them. Kliq does not control the content or the types of information that our Brands may choose to collect or manage using the Platform. That information belongs to them and is used, disclosed, and protected by them according to their own privacy policies. Brands are responsible for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to transferring data to Kliq for processing purposes.

3. How We Use Your Information

  • To Provide and Improve the Platform: To operate, maintain, and improve the Platform, including to personalize your experience, provide you with relevant content and recommendations, and develop new features.
  • To Facilitate Collaborations: To connect Brands and Content Creators, facilitate collaborations between them, manage campaigns, track performance, and process payments.
  • To Communicate with You: To communicate with you about your account, collaborations, platform updates, and other relevant matters. We may also send you service-related notifications, updates, security alerts, and support messages.
  • To Send You Marketing Communications: With your consent, we may send you emails or other communications about new features, promotions, and other updates related to the Platform. You can opt-out of these communications at any time.
  • For Analytics and Research: To analyze trends, usage patterns, and user demographics to improve the Platform and our services. This may include creating profiles about Content Creators based on their reach, audience context (country, demographics, industry), and other relevant variables from their social networks to help Brands find suitable partners. We may also use your information for research purposes, such as to analyze influencer marketing trends and develop industry insights.
  • To Protect Our Rights and Interests: To protect our rights, property, and interests, to comply with legal obligations, and to prevent fraud and abuse.
  • For Legal Compliance: To comply with applicable laws, regulations, legal processes, or governmental requests.
  • For Marketing and Promotion: As stated in our Terms & Conditions, we use Brand details, Content Creator details (including profile information and audience metrics), and Campaign Content (including approved and published Content) to promote, improve, and market the Platform and its Services.

4. How We Share Your Information

  • Between Brands and Content Creators: Information necessary for campaign collaboration (e.g., Brand briefs shared with Creators, Creator profiles shared with Brands, communications) is shared directly between relevant users on the Platform. Brands may use your personal information and data according to their own privacy policy.
  • With Service Providers: We share information with third-party vendors, consultants, and other service providers who perform services on our behalf, such as payment processors, data hosting, analytics providers, and customer support services. These service providers are obligated to protect your information and use it only for the purposes for which it was disclosed.
  • With Affiliates: We may share your information with our affiliates, including Click Digital, for business and operational purposes consistent with this Privacy Policy.
  • With Business Partners: We may share your information with business partners who offer products or services that may be of interest to you, but only with your consent.
  • With Legal Authorities: We may disclose your information to legal authorities if required by law or legal process, or if we believe in good faith that such disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a judicial proceeding, court order, or legal process.
  • Business Transfers: In connection with a merger, acquisition, reorganization, sale of assets, or in the event of bankruptcy, your information may be transferred as part of that transaction.
  • With Your Consent: We may share your information with third parties when we have your explicit consent to do so.

  • Marketing Communications: You can opt-out of receiving promotional emails from us by following the unsubscribe instructions in those emails or by updating your communication preferences in your Account settings.
  • Cookies: You can disable cookies in your browser settings, but this may affect your ability to use certain features of the Platform.
  • Location Information: You can control the collection of location information through your device settings.
  • Social Media: You can control the information we collect from social media accounts by adjusting your privacy settings on those platforms. You can also withdraw Kliq's permission to access your data from social media platforms at any time via each respective social media platform's settings. Please note that by withdrawing your authorization, your experience on our Platform may be limited and certain functionalities may be removed.
  • Data Access and Correction: You can request access to or correction of your personal information by contacting us.
  • Erasure (Right to be Forgotten): You have the right to request the deletion of your personal data if it is no longer necessary for the purpose for which it was collected or if we are no longer authorized to process it, subject to certain legal obligations or legitimate business purposes (e.g., data related to completed campaigns or financial transactions).
  • Objection to Processing: You have the right to object at any time to the processing of your personal data based on our legitimate interest, including profiling, or for direct marketing purposes.
  • Withdraw Consent: Where we rely on your consent to process your personal data, you have the right to withdraw that consent at any time. This will not affect the lawfulness of processing based on consent before its withdrawal.
  • Data Portability: You may request a copy of your personal data in a structured, commonly used, machine-readable format. Where technically feasible, you can also request that your data be transmitted directly to another company.
  • Right to Limit Processing: You have the right to limit the processing of your data in specific cases, such as when you have contested the accuracy of your personal data, or if you believe the processing is unlawful but do not wish for deletion.

10. Children's Privacy

The Kliq Platform is not intended for individuals under the age of 18. We do not knowingly collect personal information from children under 18. If we become aware that we have collected personal information from a child under 18 without parental consent, we will take steps to remove that information from our servers.

We may update our Privacy Policy from time to time. We will notify you of any changes by posting the new Privacy Policy on this page and updating the "Effective Date" at the top. If the revised version includes a material change that affects the processing of your data, we will notify you by posting a notice on our website or communicating it to you via email as soon as such changes are effective.
